In a recent Oregon Court of Appeals decision, the Court affirmed a favorable summary judgment decision obtained by Stewart Sokol & Gray at the trial court level on behalf of its client. The litigation arose from a commercial crime insurance policy issued by Stewart Sokol & Gray's client. The insured alleged that principals of Capital Consultants, LLC, an independent investment management firm retained by the insured, committed dishonest acts causing the insured millions of dollars in losses. The insured argued that the alleged dishonest principals of the independent firm were "employees" under the terms of the policy. The Court rejected all of the contentions asserted by the insured, and affirmed the trial court defense judgment.
